(1) Charges for packaging and freight, including post and courier services, are aditional to the prices quoted for rootstocks.

(2) The Australain Pome Fruit Improvement Program Ltd. accepts no liability for the condition of material delivered by other parties.

(3) The material provided has not been tested by any virus.

(4) The material provided under this contract is collected from propagation materials supplied and represented to the Australian Pome Fruit Improvement Program by the supplier as being the rootstock so named.

(5) The liability of the Australian Pome Fruit Improvement Program Ltd. for any breach of the term, conditions or warranties of this contract whether express or implied, shall, to the extent of the law permits, be and is hereby limited to repayment to the purchaser by the Australian Pome Fruit Improvement Program Ltd. of the purchase price of the material the subject matter of this contract and the Australian Pome Fruit Improvement Program Ltd. shall in no event be liable for any loss of profits or other loss or damage whatsoever.

(6) The Australian Pome Fruit Improvement Program Ltds. must be notified of any alleged shortages or damage to rootstocks within 14 days of delivery.

(7) Terms of payment are net 30 days from the date of delivery.
